However, the biggest problem in dealing with apostille abroad arises when, in addition to the apostille itself, it is also necessary to deal with the document that is the subject of the negotiations. These are, for example, situations where the office issuing the apostille allows it to be processed only for documents that are not older than 3 years and in some cases even 6 months – for example, a birth certificate or an extract from the criminal record. Requesting new originals of these documents is not a walk in the rose garden, so it is always better to get help from professionals.

Choice between apostilization and superlegalization

It also often happens that people do not know whether they need apostille or superlegalization. Authorities, banks, business partners or universities can only provide general information about the apostille, but country-specific superlegalization may be necessary. Things are complicated by the fact that they can provide you with incorrect information. For example, if you want to buy a company or sell a company abroad, you need a proven signature on the contract of transfer of the company. At the tax office, a regular worker will tell you that they need an apostille, but later their supervisor will find out that they actually need superlegalization.

The problem is that this condition applies not only to the apostille, but also to the extract from the Commercial Register itself, and therefore you have to hurry with the processing of both documents.

A similarly demanding situation occurs when handling or renewing a temporary stay or residence abroad. Even in this case, you need to submit statements within three months of their issuance, otherwise they will be unusable for this purpose. Obtaining these documents can take several months, especially if you are in person abroad and handle everything remotely. However, the experts are well versed in this respect and they know all the obstacles very well, so they can solve this bureaucracy much faster for you.

Federal Vs. state apostille

Many states function as federations and thus have two parallel structures of state bodies. These include, for example, the USA, Brazil, Germany and many other countries. The United States alone consists of 50 states (New York, Texas, California, etc.), each of which issues its own documents, and thus its own apostille.

However, the federal authorities also issue their own documents and their own apostille. Sometimes it is not clear whether, for example, a federal criminal record with a federal apostille or a state criminal record with a state apostille should be used. Similarly complicated situations can arise in connection with a birth certificate, diploma and many other documents. So professional help is more suitable here than anywhere else.

Application forms

The request for apostille is made using the appropriate forms, the form and content of which are standardized by the given foreign office. There are several versions of the apostille application on the Internet, and if you use an incorrect or outdated version of the form, you can expect your application to be rejected automatically.

It works similarly when a teacher with a foreign diploma applies for a job in the Czech Republic, or in the case of employees proving a foreign qualification. Anyone who decides to deal with an apostille abroad usually faces several problems. The first of these may occur upon payment. In many foreign countries, it is not possible to settle administrative fees by bank transfer, not even the apostille fee. Federal and state authorities only accept checks, stamps, or cash payments for personal visits.

For example, if you want to order an apostille directly at an office abroad, you must attach to your application, in addition to the correctly completed application with the form, a check linked to a local account with the appropriate balance in local currency.

As we have already mentioned, in addition to checks, you can use foreign stamps or, exceptionally, foreign cash when paying apostille fees. Just because of these complications, it is always better to turn to experienced professionals who have a US account.

Return delivery of the apostille

Foreign authorities need an apostille to send them the original document. Once they have issued the apostille and attached it to the original document, they need an envelope from the applicant, filling in his return address and the affixed foreign stamps of the correct value. And this is where the situation becomes more complicated, because finding foreign postage stamps is an almost impossible task.

The return envelope with stamps can be replaced by a prepaid courier form to the applicant’s return address. Here too, however, a problem arises because foreign companies, such as FedEx, DHL or UPS, do not allow foreigners to order delivery services from a domestic courier (either within the country or outside the home country). At the same time, they also only offer delivery abroad, but not from abroad to your address or only within abroad. Therefore, it pays to entrust the apostille process to experienced professionals who will save you both your time and money.
